Dealer Rent A Car LLC

These Vehicle Rental Terms and Conditions (“Terms”) apply to every reservation and rental supplied by Dealer Rent A Car LLC, a company organised under the laws of the United Arab Emirates and based in Abu Dhabi (“Owner”, “Dealer Rent A Car”, “we”, “us” or “our”).

The person or legal entity identified as the tenant in the applicable rental agreement is referred to as the “Tenant”, “you” or “your”.

These Terms, the signed or electronically accepted rental agreement, vehicle-condition report, booking confirmation, rate schedule, insurance terms and any written amendment accepted by the Owner together form the “Rental Agreement”.

1.  Rental Agreement

1.1

By signing, electronically accepting, paying for, collecting or using the Vehicle, the Tenant confirms that the Tenant has read, understood and accepted the Rental Agreement.

1.2

The rental agreement issued for a particular Vehicle will specify or incorporate:

  • the Tenant and authorised drivers;
  • Vehicle details;
  • rental commencement and return dates;
  • agreed rental rate;
  • mileage allowance;
  • security deposit or card authorisation;
  • applicable insurance terms;
  • additional services; and
  • other rental-specific charges or

1.3

Where there is an inconsistency, a specifically negotiated written term in the rental agreement will prevail over these general Terms to the extent of the inconsistency, unless the applicable term is prohibited by law.

2.  Definitions

In these Terms:

“Additional Driver” means a driver expressly recorded or approved by the Owner.

“Authorised Driver” means the Tenant and each Additional Driver who satisfies the eligibility requirements.

“Chargeable Damage” has the meaning described in Section 15.

“Rental Period” means the period beginning when the Vehicle is delivered or made available to the Tenant and ending when it is returned to and formally accepted by the Owner.

“Vehicle” includes the rented motor vehicle and all keys, tyres, tools, accessories, equipment and documents supplied with it, together with any replacement vehicle.

3.  Reservations and Vehicle Availability

3.1

A reservation is subject to:

  • Vehicle availability;
  • identity and driving-licence verification;
  • payment or deposit approval;
  • satisfaction of the Owner’s eligibility and risk requirements; and
  • acceptance of the Rental

3.2

A booking for a particular model does not guarantee that exact model unless expressly confirmed. Where necessary, the Owner may provide a reasonably comparable vehicle in the same or a higher category, subject to availability.

3.3

The Owner may refuse or cancel a rental where:

  • eligibility information is false, incomplete or unverifiable;
  • payment authorisation fails;
  • fraud or unlawful use is reasonably suspected;
  • the proposed use creates an unacceptable safety or credit risk; or
  • the rental cannot lawfully be

Any refund will be handled in accordance with the applicable booking or cancellation terms and mandatory law.

4.  Driver Eligibility

4.1

The Tenant and every Additional Driver must:

  • be at least twenty-one years old;
  • hold a valid driving licence recognised by the competent UAE authorities;
  • hold any additional permit required by law;
  • be legally entitled to drive the relevant Vehicle category;
  • provide acceptable identity and licence documents; and
  • remain eligible to drive throughout the Rental

4.2

The Tenant must ensure that only Authorised Drivers operate the Vehicle.

4.3

The Vehicle must not be operated by:

  • an unlicensed or unauthorised person;
  • a person whose licence is suspended, expired, cancelled or invalid;
  • a person affected by alcohol, narcotics, medication or another substance that impairs safe driving;
  • a person medically unfit to drive; or
  • a person who obtained possession of the Vehicle through false or misleading

4.4

The Tenant is responsible for the conduct of each Authorised Driver and must ensure that every Authorised Driver complies with the Rental Agreement.

5.  Permitted Use and Territorial Restrictions

5.1

The Vehicle may be used only:

  • for lawful personal or business transportation;
  • on roads appropriate for the Vehicle;
  • within the United Arab Emirates; and
  • in accordance with the Vehicle manufacturer’s operating

5.2

The Vehicle must not be taken outside the UAE without the Owner’s prior express written authorisation and any required insurance, border, customs or governmental approvals.

5.3

Unless expressly authorised in writing, the Vehicle must not be used:

  • for racing, speed testing or competitive events;
  • for driver training or driving tests;
  • for towing, pushing or propelling another vehicle or object;

  • in floodwater or conditions where continued driving is plainly unsafe;
  • after a warning light or mechanical defect indicates that continued operation may cause damage; or
  • in violation of any traffic, transport, customs or other applicable

5.4

Smoking in the Vehicle is prohibited unless the Owner expressly agrees otherwise in writing.

5.5

Animals may not be transported without the Owner’s prior approval. The Tenant is responsible for any resulting cleaning, odour-removal or damage costs.

6.  Vehicle Delivery and Condition

6.1

The Tenant confirms that, at the beginning of the rental, the Tenant has had a reasonable opportunity to inspect the Vehicle and that it is received in good working condition except for damage recorded in the condition report.

6.2

The Owner may record the Vehicle’s condition through:

  • a written or electronic damage map;
  • photographs;
  • video;
  • mileage and fuel readings; and
  • a signed or electronically accepted inspection

6.3

The Tenant should inspect the Vehicle before departure and immediately notify the Owner of any visible damage not shown in the condition report.

6.4

The Tenant is responsible for safeguarding the Vehicle, keys, registration documents, accessories and equipment during the Rental Period.

7.  Rental Period and Extensions

7.1

The Vehicle must be returned on the agreed date, at the agreed time and to the agreed location unless an extension is approved by the Owner.

7.2

An extension is not effective until accepted by the Owner and any additional payment or authorisation requirement is satisfied.

7.3

Keeping the Vehicle beyond the agreed return time without approval constitutes a breach of the Rental Agreement and may result in:

  • additional rental charges;
  • loss of any discounted rental rate;
  • recovery action;
  • reporting to the competent authorities where reasonably necessary; and
  • other direct costs caused by the unauthorised

7.4

Where the Vehicle is returned more than three hours after the agreed return time, the Tenant may be charged one full additional rental day.

This does not permit the Tenant to retain the Vehicle without approval.

8.  Return of the Vehicle

8.1

The Vehicle must be returned:

  • at the agreed location;
  • during the Owner’s accepted return hours;
  • with all keys, documents and accessories;
  • in substantially the same condition as at delivery, allowing for fair wear and tear;
  • with the agreed fuel level; and
  • free from personal belongings and excessive dirt, stains, smoke, odours or

8.2

Unless otherwise agreed in writing, the Owner does not accept vehicle returns on official public holidays.

The Tenant must arrange return before or after the public holiday as instructed by the Owner. Rental charges continue until the Vehicle is properly returned and accepted.

8.3

Leaving the Vehicle at the Owner’s premises or another location without an authorised representative does not by itself complete the return.

The Rental Period and the Tenant’s responsibility may continue until the Vehicle is located, inspected and accepted by the Owner, subject to applicable law.

8.4

The Tenant should remain available for the return inspection. If the Tenant leaves before inspection or returns the Vehicle outside authorised hours, the Owner may inspect it later and provide reasonable evidence of newly identified damage or shortages.

9.  Rental Charges, Deposit and Payment

9.1

The Tenant must pay:

  • the agreed rental charge;
  • applicable VAT;
  • security deposits;
  • additional-driver or optional-service charges;
  • excess-mileage charges;
  • fuel charges;
  • tolls, fines and parking charges;
  • damage and insurance amounts properly payable under the Rental Agreement;
  • late-return and extension charges;
  • cleaning, recovery and replacement costs;
  • administrative charges disclosed in the Rental Agreement or applicable fee schedule; and
  • all other properly incurred amounts arising from the

9.2

Unless expressly stated otherwise, quoted prices exclude VAT and additional usage-dependent charges.

9.3

The amount and form of the security deposit may vary according to the Vehicle, Rental Period, payment method and customer risk profile and will be stated in the rental agreement or booking confirmation.

9.4

A deposit is security for payment and does not limit the Tenant’s liability.

9.5

Subject to deductions for outstanding amounts, the security deposit will ordinarily be released or refunded within ten to fourteen business days after closure of the rental contract.

The Tenant acknowledges that:

  • traffic fines, tolls or government charges may be reported after the Vehicle is returned;
  • a bank or card issuer may take additional time to display a released pre-authorisation; and
  • the Owner may retain a reasonable amount where an identifiable charge, claim or incident remains

9.6

The Owner will provide a reasonable explanation of deductions upon request.

10.  Credit-Card and Payment Authorisation

10.1

The Tenant authorises the Owner and its payment providers to charge the payment card supplied for amounts properly payable under the Rental Agreement, including:

  • rental fees;
  • extensions;
  • fuel refilling;
  • tolls;
  • traffic fines;
  • parking charges;
  • repair or replacement costs;
  • insurance excess or accident charges;
  • loss or damage not covered by insurance;
  • late-return charges;
  • overdue payments;
  • recovery, towing or repossession costs; and
  • disclosed administrative or processing

10.2

Where an amount remains unpaid for more than three calendar days after becoming due, the Owner may charge the authorised card without a further payment instruction, provided that the charge is authorised by the Rental Agreement and supported by a reasonable record.

10.3

The Tenant must maintain a valid payment method during the Rental Period and promptly update payment details if the original method becomes invalid.

10.4

The Owner may request an Al Etihad Credit Bureau assessment where reasonably necessary, legally permitted and subject to any required authorisation.

11.  Mileage

11.1

The mileage allowance applicable to the rental will be stated in the rental agreement.

11.2

Mileage exceeding the agreed allowance will be charged at AED 0.50 per kilometre, unless a different rate is expressly stated in the rental agreement.

11.3

Tampering with, disconnecting or interfering with the odometer, GPS or mileage-recording equipment is prohibited.

Where reliable mileage cannot be obtained because of interference attributable to the Tenant, the Owner may reasonably estimate usage using tracking, service or journey records.

12.  Fuel

12.1

The Vehicle must be returned with the same fuel level recorded at the start of the rental unless a different written fuel arrangement applies.

12.2

Where the Vehicle is returned with less fuel, the Tenant must pay:

  • the reasonable cost of replacement fuel; and
  • any refuelling service charge disclosed in the Rental Agreement or fee

12.3

The Tenant is responsible for using the correct fuel.

Fuel contamination, misfuelling or associated mechanical damage is Chargeable Damage and is not treated as fair wear and tear.

13.  Traffic Fines, Tolls, Parking and Government Charges

13.1

The Tenant is responsible for all traffic offences, tolls, including Salik and Darb, parking charges, impoundment charges and other vehicle-related liabilities arising during the Rental Period or from the Tenant’s use of the Vehicle.

13.2

The Tenant authorises the Owner to:

  • identify the Tenant or Authorised Driver to the competent authority;
  • transfer a violation where a lawful transfer process is available;
  • pay or process the amount where necessary;
  • charge the Tenant’s authorised payment method; and
  • charge a reasonable, previously disclosed administrative fee for processing the

13.3

The Tenant remains responsible for fines and charges reported after the rental has closed where they relate to the Rental Period.

13.4

Any dispute concerning whether an offence occurred must ordinarily be raised with the issuing authority. The Owner will reasonably assist by supplying available rental records where appropriate.

14.  Accidents, Theft, Damage and Breakdown

14.1

In the event of any accident, collision, theft, fire, flood, vandalism, hit-and-run incident or damage occurring while the Vehicle is parked, the Tenant must:

  • stop and protect the Vehicle where safe;
  • contact the police or competent accident-reporting authority immediately;
  • notify the Owner immediately;
  • obtain a valid police or official incident report;
  • not admit liability or agree to settle a third-party claim without authorisation;
  • collect available third-party and witness details;
  • take reasonable photographs where safe;
  • protect the Vehicle from further loss; and
  • fully cooperate with the Owner and

14.2

The Tenant must not arrange repairs, towing or replacement parts without the Owner’s authorisation, except where immediate action is reasonably required to prevent greater harm or comply with police instructions.

14.3

The Tenant must not abandon the Vehicle.

14.4

Mechanical breakdown that is not caused or worsened by the Tenant must be reported promptly. The Owner will arrange reasonable assistance subject to availability and the circumstances.

15.  Damage Standards

15.1

“Chargeable Damage” means new damage occurring during the Rental Period that is not:

  • recorded as pre-existing;
  • fair wear and tear;
  • accepted as an insured loss for which the Tenant has no contractual responsibility; or
  • caused solely by the Owner after the Vehicle was properly

15.2

Subject to inspection and reasonable evidence, Chargeable Damage includes:

Scratches: Marks longer than 10 mm, or any scratch of 10 mm or less where underlying metal, primer, paint substrate or plastic is exposed.

Scuffs: Two or more scratches in one location, several marks forming an affected area greater than 10 mm, or smaller marks exposing the underlying material.

Dents: Any indentation or visible body-panel or panel-gap misalignment greater than 10 mm.

Glass and lights: Chips, cracks or breakage affecting windscreens, windows, light clusters or mirrors.

  • a damage map;
  • inspection reports;
  • police reports;
  • repair estimates;
  • invoices;
  • expert assessments; and
  • manufacturer or repair-facility

15.4

The Tenant will be given a reasonable opportunity to raise questions concerning damage charges and request supporting information.

16.  Insurance

16.1

The Vehicle is insured in accordance with applicable UAE requirements and the applicable policy terms.

A copy or relevant summary of the insurance policy will be provided on written request, subject to confidential or commercially sensitive information being redacted where appropriate.

16.2

Insurance coverage is subject to:

  • the insurer’s policy terms;
  • applicable law;
  • authorised use of the Vehicle;
  • driver eligibility;
  • timely reporting;
  • provision of a valid police report; and
  • cooperation with the insurer and

16.3

Insurance does not remove the Tenant’s responsibility for contractual charges, exclusions, uninsured losses or damage caused by a policy breach.

17.  Accident Liability and Insurance Contributions

 At-fault or unattributed accidents

Where a valid police report determines that the Tenant or an Authorised Driver was at fault, or where fault cannot be attributed to an identifiable third party, the Tenant must pay, subject to applicable law and insurance terms:

  • a fixed accident charge of AED 1,500;
  • twenty percent of the total reasonable repair cost; and
  • the applicable rental or loss-of-use charge during the reasonable repair

These amounts will not be charged twice for the same underlying loss and will be adjusted where required by the applicable insurance policy or mandatory law.

Total loss

Where the Vehicle is declared a total loss and the loss is covered by insurance, the Tenant must pay, subject to applicable law and policy terms:

  • AED 1,500; and
  • twenty percent of the insured value of the

Any amount recovered from another responsible party or insurer for the same loss must be taken into account to prevent double recovery.

Not-at-fault accidents

Where a valid police report establishes that an identifiable third party was solely at fault, the Tenant will not be charged for insured physical damage attributable to that party.

The Tenant may remain responsible for the agreed rental or loss-of-use charge during the reasonable repair period, only to the extent permitted by law and reflecting the actual period during which the Vehicle is unavailable.

Missing police report

Failure to obtain a required valid police or official report may prevent insurance recovery.

Where the failure causes insurance coverage to be refused, the Tenant may be liable for the resulting damage and loss to the extent caused by the Tenant’s breach and permitted by law.

 Insurance invalidation

Where insurance is invalidated because of an act or omission of the Tenant or an Authorised Driver, including:

  • unauthorised driving;
  • unlicensed driving;
  • intoxicated or impaired driving;
  • unlawful use;
  • use outside an authorised territory;
  • racing or off-road use;
  • deliberate or fraudulent conduct;
  • material misrepresentation; or
  • failure to make a required police report,

the Tenant is responsible for the Owner’s uninsured losses, including Vehicle damage and properly established third-party liabilities, to the extent permitted by law.

No double recovery

The Owner is not entitled to recover more than its properly established loss, contractual charge and reasonable associated costs after accounting for insurance and third-party recoveries.

18.  Loss of Use and Repair Period

18.1

Where the Vehicle cannot be rented because of damage for which the Tenant is responsible, the Tenant must pay the applicable rental or reasonable loss-of-use charge for the substantiated repair period, subject to:

  • reasonable steps by the Owner to obtain and complete repairs;
  • delays outside the Tenant’s responsibility being excluded where required by law;
  • insurance or third-party recoveries being taken into account; and
  • the Owner not recovering twice for the same

18.2

The repair period may include the reasonable time required for assessment, insurer approval, parts procurement and repair where supported by appropriate records.

19.  Impoundment, Confiscation and Seizure

19.1

Where the Vehicle is impounded, seized, confiscated or detained because of the Tenant’s or an Authorised Driver’s act or omission, the Tenant is responsible for:

  • government fines;
  • towing;
  • storage;
  • release and recovery costs;
  • applicable rental or loss-of-use charges; and
  • physical damage or reduction in Vehicle value, to the extent permitted by law.

19.2

Where the Vehicle is permanently confiscated, cannot lawfully be recovered, or is treated by the insurer as a total loss because of the Tenant’s breach, the Tenant may be liable for the Owner’s resulting uninsured loss up to the properly established value of the Vehicle, after deducting insurance or other recoveries.

The Tenant will not automatically owe the full insured value merely because of a temporary impoundment where the Vehicle is subsequently recovered without equivalent loss.

The Tenant must pay the reasonable replacement, programming, delivery and associated security costs for:

  • lost or damaged keys;

The Tenant must remove personal property when returning the Vehicle.

21.3

To the extent permitted by law, the Owner is not responsible for personal items left in the Vehicle unless loss or damage is caused by the Owner’s fraud, deliberate misconduct or gross negligence.

21.4

Items found may be stored for a reasonable period and then disposed of, delivered to an appropriate authority or otherwise handled in accordance with law. The Tenant is responsible for reasonable delivery or storage costs.

22.  GPS, Telematics and Vehicle Security

22.1

The Vehicle may be fitted with GPS, telematics, security, diagnostic or immobilisation technology.

22.2

The Owner may use such technology for:

  • fleet management;
  • vehicle location;
  • theft prevention and recovery;

  • detecting unauthorised cross-border or prohibited use;
  • responding to overdue return or payment default;
  • investigating accidents or contractual breaches; and

  • rental charges remain unpaid beyond the applicable grace period;
  • traffic fines associated with the rental exceed AED 1,000;
  • the Vehicle has not been returned as agreed;
  • unlawful or dangerous use is reasonably suspected; or
  • another material breach creates a serious security or recovery

22.5

A remote immobilisation function must not knowingly be activated while the Vehicle is moving or where activation would create an unreasonable safety risk.

23.2

Where reasonably practicable, the Owner will provide notice and an opportunity to correct a remediable breach before recovery.

Immediate action may be taken in cases involving suspected theft, fraud, unlawful use, abandonment or serious danger.

23.3

The Tenant must provide access to and surrender the Vehicle upon lawful termination.

23.4

The Tenant is responsible for reasonable recovery, towing, storage and repossession costs arising from the Tenant’s breach.

23.5

Recovery will be conducted in accordance with applicable law. Nothing in these Terms authorises unlawful entry, threats, breach of the peace or unsafe immobilisation.

24.  Cancellation, No-Show and Early Return

24.1

The cancellation, amendment and no-show rules applicable to a booking must be stated in the booking confirmation, rate terms or rental agreement.

24.2

Unless the applicable booking terms state otherwise, prepaid amounts are refundable for the unused rental period only where:

  • the Owner cancels without a Tenant default;
  • the Vehicle cannot be supplied and no reasonable replacement is accepted;
  • a force-majeure termination qualifies under Section 31; or
  • a refund is otherwise required by

24.3

An early return does not automatically entitle the Tenant to a refund of unused rental days where the agreed rate was priced for a fixed rental period, unless the rental agreement provides otherwise or mandatory law requires a refund.

24.4

The Owner must not retain amounts that it is legally required to refund.

25.  Communications and Electronic Acceptance

25.1

The Tenant agrees that rental communications may be sent to the telephone number, WhatsApp number or email address supplied by the Tenant.

25.3

A WhatsApp message sent from or to the Owner’s registered business number may be relied upon as evidence of a communication or agreed instruction.

25.4

A digital communication does not amend the Rental Agreement unless:

  • it clearly records the proposed amendment;
  • it is sent by a person authorised to agree to it; and
  • the other party expressly accepts it or acts on it in circumstances showing

25.5

The Tenant must promptly notify the Owner if the Tenant’s registered contact details change or are compromised.

26.  Privacy

The Owner processes identity, licence, payment, rental, vehicle-location, accident and other personal data in accordance with the Dealer Rent A Car LLC Privacy Policy.

Privacy questions and requests may be submitted to drive@casanova.ae.

27.  Owner’s Responsibilities

  • false information supplied by the Tenant;
  • damage for which the Tenant is responsible;

  • a third-party claim caused by the Tenant or an Authorised Driver,

except to the extent the loss was caused by the Owner or has already been recovered through insurance or another party.

30.  Compliance With Law and Authorities

The Owner may provide rental, driver, vehicle and payment information to police, courts, traffic authorities, toll operators, insurers and other competent bodies where:

  • required by law;
  • required by a lawful request;
  • necessary to process an offence or claim;
  • necessary to protect a person or property; or
  • reasonably necessary to establish or defend legal

31.  Force Majeure

31.1

31.4

If the event continues for fifteen consecutive days and materially prevents the rental from continuing, either party may terminate the affected rental without a termination penalty.

31.5

Upon such termination, the Owner will refund prepaid rental charges attributable to the unused Rental Period after deducting:

33.  Complaints and Disputes

33.1

The Tenant should first submit a complaint to:

36.  Entire Agreement

The Rental Agreement constitutes the entire agreement concerning the relevant rental and replaces previous discussions, representations or understandings relating to that rental.

This does not exclude liability for fraud or for a statement that cannot legally be excluded.

37.  Amendments

No material amendment is effective unless recorded in writing or in an authenticated electronic communication and accepted by authorised representatives of the relevant parties.

The Owner may update its general Terms for future rentals. Updated Terms do not retrospectively alter an existing rental unless agreed or required by law.

38.  Waiver

A failure or delay in exercising a right does not waive that right.

Acceptance of part-payment does not waive the Owner’s right to claim the remaining properly payable balance.

A waiver concerning one breach does not constitute a waiver of another breach.

If a provision is held unlawful, invalid or unenforceable, it will be interpreted or reduced to the minimum extent required to make it enforceable where possible.

The remaining provisions will continue in effect.

40.  Assignment
